Fire Risk Assessments – The Legal Position

The Regulatory Reform (Fire Safety) Order 2005 applies to almost all non-domestic premises in England and Wales.

With limited exclusions (such as certain transport settings), the Order applies to:

  • Workplaces and commercial premises
  • Buildings open to the public
  • Common areas of multi-occupied residential buildings

Under the Order, a Responsible Person is anyone who:

  • Has control of premises
  • Has control over certain areas or systems within a building

This can include employers, owners, occupiers, managing agents, and contractors.

Duties of the Responsible Person

The Fire Safety Order places a general duty on the Responsible Person to:

  • Ensure the safety of all relevant persons on the premises
  • Protect others who may be affected by a fire
  • Carry out a suitable and sufficient fire risk assessment
  • Implement appropriate and adequate fire safety measures
  • Reduce risk to life to a level that is as low as reasonably practicable

Failure to meet these duties can result in enforcement action, prosecution, and severe consequences.

Appointing a Fire Risk Assessment Consultant

When you appoint a fire risk assessor, you are delegating a critical task — but not the legal responsibility.

The duty to ensure that a suitable and sufficient fire risk assessment is in place always remains with the Responsible Person. That is why the competence of the assessor you appoint is just as important as the assessment itself.

Choosing the right consultant protects you, your organisation, and the people within your premises.
